The Allsup Medicare Advisor is provided by Allsup Healthcare Insurance Services, LLC, a wholly-owned subsidiary of Allsup, LLC. Allsup, LLC and Allsup Healthcare Insurance Services, LLC are sometimes, collectively, referred to in these Sales Terms and Conditions as “Allsup.”
1. User’s Acknowledgment and Acceptance of Terms
As a condition to enrolling in and using the Allsup Medicare Advisor service, you also agree to the following additional terms and conditions. If you do not wish to be bound by these additional terms and conditions, do not enroll in or use the Allsup Medicare Advisor service. In the event of any conflict between these additional terms and conditions and the policy and terms and conditions referenced above, these additional terms and conditions shall govern and control.
Allsup does not provide tax, legal, investment, financial planning or medical advice or counsel under the Allsup Medicare Advisor. You are responsible for making all decisions with respect to the products and services you utilize under the Allsup Medicare Advisor, including but not limited to selecting the Medicare coverage that best matches your needs, and for obtaining any personal tax, legal, investment, insurance, financial planning, medical or other advice or counsel that you believe is necessary or advisable with respect to such products or services.
The analysis and results produced by Allsup Medicare Advisor are heavily based on the information provided by you to the service. As such, Allsup assumes no liability resulting from inaccurate, incomplete, or invalid information provided by you.
Although Allsup Medicare Advisor may explain your Medicare options and, if requested, Allsup and/or its affiliates may assist you with enrollment in a Medicare plan, you are solely responsible for making any final Medicare coverage decisions and enrolling by the deadline that applies to your given situation.
Allsup assumes no liability for your Medicare coverage choices based on inaccurate, incomplete, or invalid information in any format provided by Medicare or individual insurance companies offering Medicare coverage options.
You agree to respond to requests for information and documentation required to perform the service. Allsup assumes no liability for damages caused by your failure to provide requested information and documentation in a timely manner.
You are solely responsible for coordinating your Medicare coverage with any benefits and health insurance coverage offered through an employer or otherwise. If you have existing coverage offered through a former employer or spouse’s employer, you must review your options with the employer before making any coverage changes. Great care must always be taken when deciding to terminate employee/retiree/spousal healthcare coverage through an employer.
Allsup does not represent or work for Medicare or Medicaid. If you need help applying for Medicaid, contact your state Medicaid office.
In order to provide the Allsup Medicare Advisor service, Allsup will use and disclose information about you. This information may include, but is not limited to, specific personal, financial and/or medical information. You authorize and consent to Allsup’s use and disclosure of all such information.
Your enrollment in the Allsup Medicare Advisor service is not effective until it is accepted by Allsup at its principal place of business in Belleville, Illinois. In the event of any dispute, you accept the jurisdiction and venue of any state and/or federal court located in Illinois and agree that such dispute shall be governed by Illinois law (without giving effect to any principles of Illinois law that would result in the application of a different state’s law).
3. Scope of Service
The Allsup Medicare Advisor is designed to help individuals identify and select the Medicare options that best fit their needs. However, the assistance provided and fee charged, if any, is on a per-enrollment basis. Assistance for additional future enrollment periods may be subject to an additional fee.
Allsup Medicare Advisor is not a one-size-fits-all service. The plans we identify through our analysis are tailored exclusively to individual participants. If you want to provide a relative or someone you live with and who is Medicare eligible with the same type of service, an additional fee may apply.
For first-time enrollees or enrollees eligible for a special enrollment period under Medicare rules, the information provided by this service will primarily cover the current year only. Because plans may be added or dropped from the Medicare program, or could change from year to year, you should review your Medicare plan options every year. Such reviews are available through Allsup, and an additional fee may apply.
In connection with the Allsup Medicare Advisor service, you may be provided with information regarding insurance plans, policies and other products. An Allsup affiliate may serve as an agent or in a similar capacity for insurers or other third parties that sponsor, underwrite, insure, promote or provide such insurance plans, policies and other products and may receive commissions or other payments from such insurers and third parties, if you choose to enroll in and/or purchase these insurance plans, policies and other products. You acknowledge that such commissions and other payments are in addition to fees, if any, paid in connection with the Allsup Medicare Advisor service and agree to the receipt and retention by any such Allsup affiliate of all such commissions and other payments.
4. Refund and Cancellation Policy
You have up to three business days from the date of payment or the establishment of alternative payment arrangements, acceptable to Allsup, within which to cancel this service. You may effect such cancellation and, if payment has been made, receive a full refund, by contacting us at (866) 521-7655 or via email. Except as indicated immediately below, no refunds will be made after this period. Allsup may, in its sole discretion, cancel its provision of this service to you for any reason and at any time by calling you at the telephone number you have provided or by email. If such cancellation by Allsup occurs within three business days of the date of payment, and payment has been made, you will receive a full refund. If Allsup cancels its provision of this service to you more than three business days after payment has been made, any refund of the amount paid by you shall be at Allsup’s sole discretion.
If the Allsup Medicare Advisor service is being provided at no cost to you, then, in the event of any cancellation, no refund will be made to you.
5. Disclaimer of Warranties
ALL MATERIALS AND SERVICES ON THIS SITE ARE PROVIDED ON AN “AS IS“ AND “AS AVAILABLE“ BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THE WARRANTY OF NON-INFRINGEMENT.
